Welcome to ORTUS PRIME (“ORTUS PRIME”), a premium on demand digital video streaming service owned and operated by BRS FILM PRODUCTION.

This “Terms of Use” is an electronic record under the Information Technology Act, 2000 and any amendments made thereto along with the rules framed thereunder, as applicable, pertaining to electronic records. This electronic record is generated by a computer system and does not require any physical or digital signatures.These Terms of Use (“Terms") applies to the ORTUS PRIME digital platforms including without limitation ORTUS PRIME and other related websites, mobile applications and other online features that link to this Terms. These Terms shall apply to the websites, web pages, digital platforms, interactive features, applications, widgets, blogs, social networks, etc. (“ORTUS PRIME Platform”), alternative reality worlds or features, or other online or wireless offerings that post a link to these Terms, whether accessed computer, mobile device or other technology, manner or means.

The ORTUS PRIME Platform(s) allows users to access and view a variety of audio and audio-visual content including, inter alia, movies, web series, web films, music and videos, trailers of upcoming series and movies, music videos (collectively, “Content(s)”) that is streamed over the internet to the Devices with minimum system requirements of this Terms of Use.

For the purpose of these Terms of Use, wherever the context so requires “Company”, “Our” or “Us” means ORTUS PRIME and “You”, “Your”, “Yourself” or “User/ Subscriber” shall mean any natural or legal person who uses, accesses or avails the ORTUS PRIME Platform(s).

For the purpose of these Terms of Use, Service shall mean video on demand service and other ancillary services provided by ORTUS PRIME through ORTUS PRIME Platform(s) to Users and Subscribers for accessing and watching/ streaming Content(s), features and functionalities for Subscribers to post User Materials among others.

*ASSENT AND ACCEPTANCE

By using of the ORTUS PRIME Platform(s), access to Content(s) and/ or Service(s) are governed by the “Terms of Use” and the “Privacy Policy”. Your mere use or access of ORTUS PRIME Platform(s) constitute Your acceptance of this Terms of Use, Refund Policy and the Privacy Policy and any other terms which govern the ORTUS PRIME Platform(s), and if You do not agree to these Terms of Use, Refund policy and the Privacy Policy, You must not avail of/use the Service(s) and any use thereafter shall be deemed unauthorised.

*REGISTRATION AND CREATION OF ACCOUNT

You should at all times while accessing/using the Service (i) be a registered subscriber of ORTUS PRIME; (ii) hold a valid Account (as defined below) with ORTUS PRIME.

You will be required to create an account which will contain personal information like your name, e-mail address, and mobile number, if required (“Account”). Some of this information might need to be verified by You to proceed further through one-time-passwords or account activation links.It is recommended that You do not share Your Account details, particularly Your username and password with any third party. ORTUS PRIME accepts no liability for any losses or damages incurred as a result of (i) Your Account details being shared by You; or (ii) unauthorized access to Your Account by a third party.

If You have reason to believe that Your Account details have been obtained by another without consent, You should contact ORTUS PRIME at ortusprime@gmail.com immediately to suspend Your Account and cancel any unauthorized subscription orders or payments (if any) that may be pending. Please be aware that subscription orders or payments (if any) can only be cancelled up until provision of Services has commenced. In the event that an unauthorized provision commences prior to Your notifying as required under this section of the unauthorized nature of the order or payment, ORTUS PRIME will suspend provision of Services and the withdrawal of any scheduled payments pending investigation. Following investigation, it shall be determined whether or not to cancel the Services and permit a full or partial refund of the payment for unauthorized order or revalidate Your Account post re verification and revalidation.

*ACCESS TO THE SERVICE

Some of the ORTUS PRIME Content made available on the Service is being provided to You for free and there are no subscription charges for the usage of the Service. However, the Company reserves the right to adopt any method of monetization through the Service in the future as it deems fit.

Some of the ORTUS PRIME Content made available on the Services marked and categorized as “premium” and can be availed only by registered Users who have opted for any specific subscription plan ("Subscription User"). Notwithstanding any other clause in this Terms of Use, if You are a Subscription User, then following clause(s) shall apply:

a. ORTUS PRIME may offer different kinds of Subscription plans, each of these Subscription plans will be subject to different limitations and restrictions and the cost of each of these Subscription plans may vary.

b. ORTUS PRIME currently offers all access premium subscription pack to Users and may offer in future various subscription packages with full access to certain Content.

c. ORTUS PRIME shall have the discretion to make certain Content that is a part of the Subscription available to You on more than one end user compatible system concurrently. ORTUS PRIME shall also have the discretion to make certain Content whether forms a part of any Subscription plan or otherwise, available to You under one Account and more than one device concurrently.

This Service is offered and made available only to Users above the age of 18 years (or above 21 years of age, where a guardian is appointed as per the Majority Act of 1875) ("Age of Majority").If You are under the Age of Majority and continue accessing the Service, the ORTUS PRIME will assume that You have reviewed these Terms of Use and the Privacy Policy with Your parent/legal guardian and Your parent/legal guardian understands and agrees to it on Your behalf. If You are under the Age of Majority at the time of accessing and/or using the Service, Your access and usage of the Service shall be deemed to be subject to parental/legal guardian consent and under parental/legal guardian’s guidance at all times. Please note that the availability of the Service in Your jurisdiction, and Your ability to access the Service is subject to ORTUS PRIME’s sole discretion. ORTUS PRIME may at its sole discretion restrict the Service from being accessed in certain geographical locations. You undertake that Your access of the Service shall be in compliance with all applicable laws (as amended from time-to-time). *CONTENT CLASSIFICATION

The following standard for age classification in relation to Content(s) has been adopted:

a) Content which is suitable for children as well as people of all ages are classified as ―U rating;

b) Content which is suitable for persons aged 7 years and above, and can be viewed by a person under the age of 7 years with parental guidance, are classified as ―U/A 7+ rating;

c) Content which is suitable for persons aged 13 years and above, and can be viewed by a person under the age of 13 years with parental guidance, are classified as ―U/A 13+ rating;

d) Content which is suitable for persons aged 16 years and above, and can be viewed by a person under the age of 16 years with parental guidance, are classified as ―U/A 16+ rating; and

e) Content which is restricted to adults are classified as ―A 18+ rating.

f) Content(s) are classified on the basis of.—(i) Themes and messages; (ii) Violence; (iii) Nudity; (iv) Sex; (v) Language; (vi) Drug and substance abuse; and (vii) Horror.

You acknowledge that ORTUS PRIME does not endorse or sponsor such third party sites, content, advertising or such other materials and ORTUS PRIME takes no responsibility for any loss, or harm caused due to usage, access, or streaming of the products and/ or services provided by advertisers.
